This is happening because the trigger box surrounding where the guard belongs has been foolishly set to a direct actor reference (the Imperial one) instead of a quest alias that would hold the correct guard. That part can be fixed.
Bethesda further complicated this though by assigning all of the spoken dialogue for the encounter to that same Imperial guard rather than using a quest alias for it. That is going to take more time to work out a solution for.
